  5.                   Electronic Bulletin Board System License
  6.  
  7.        The use of The New Frontiers Shareware Explorer CD-ROMs on
  8.        electronic bulletin board systems (BBS) is prohibited without a
  9.        license from New Frontiers.  This License Agreement is between New
  10.        Frontiers nd the BBS operator whose signature appears at the end of
  11.        this Agreement.  In return for the limited right to use The New
  12.        Frontiers Shareware Explorer CD-ROM the BBS Licensee agrees to the
  13.        provisions of this License.  This Agreement allows the BBS Licensee
  14.        to use The New Frontiers Shareware Explorer CD-ROM for the period
  15.        of one year from the date of this License.
  16.  
  17.    1.  New Frontiers CD-ROMS's copyright covers the research, editing,
  18.        organization and compilation aspects of New Frontiers Shareware
  19.        Explorer CD-ROM as well as any individual programs or descriptive
  20.        materials which are the original creation of New Frontiers.  Unless
  21.        otherwise specified, New Frontiers does not claim literary rights
  22.        in individual programs which have been licensed for use.

  24.    2.  This License Agreement allows the BBS Licensee to use New Frontiers
  25.        name, file organization system and corresponding titles, and New
  26.        Frontiers developed text files including, but not limited to, file
  27.        descriptions.

  29.    3.  BBS Licensee agrees to respect the author's copyright notices on the
  30.        Shareware software and New Frontiers copyrights and trademarks.
  31.        New Frontiers copyrighted materials include the directory on disk,
  32.        and all printed directories and encyclopedias.
  33.  
  34.    4.  The BBS Licensee must have the capability, and agree, to deny access
  35.        to any program, or file on their BBS system that has been withdrawn
  36.        from The New Frontiers Shareware Explorer disc.  Notification of
  37.        program, file, withdrawal from The New Frontiers Shareware Explorer
  38.        CD-ROM will be sent to Licensee.  It is the responsibility of the
  39.        BBS Licensee to maintain their BBS according to the current
  40.        distribution status as reflected in those Notices.

  42.    5.  BBS Licensee agrees not to download files and/or programs from the
  43.        New Frontiers Shareware Explorer disc with the intent to sell the
  44.        copy.  Downloading is defined as the process of copying or
  45.        duplicating a file from New Frontiers Shareware Explorer CD-ROM
  46.        disc onto other media, including, but not limited to, diskettes,
  47.        hard drives, magnetic tape or optical disc, for the intentional or
  48.        unintentional purposes of sales, distribution or financial gain.
  49.        The BBS Licensee cannot side-step the issue of a sale by claiming
  50.        that they have only charged for consulting time, the cost of the
  51.        diskette, online time, or for labor charges only.
  52.  
  53.    6.  Because of the varying types of hardware and software for BBS
  54.        systems, New Frontiers CD-ROMS does not guarantee the compatibility
  55.        of The Shareware Explorer CD-Rom with any particular BBS system.
  56.  
  57.    8.  If Licensee violates any provisions of this Agreement, New Frontiers
  58.        can terminate this License and continued violations may possibly
  59.        lead to subsequent legal action by New Frontiers, among other
  60.        causes of action, for violation of New Frontiers License,
  61.        registered trademark(s) and/or copyright(s).

  63.    9.  The License fee is as follows:
  64.  
  65.              - $ 1 per year for any BBS system.
  66.  
  67.        This minimal license fee is intended to cover the administrative
  68.        costs of notifying you of file defects, Author requested removals,
  69.        commercial programs, etc.  Reasonable care has been taken in the
  70.        production of this CD-ROM disc, but rapid notification of any
  71.        potential problems is in the best interests of both the BBS
  72.        operator and the CD-ROM producer.
  73.  
  74.        Each bulletin board system is only required to pay a single fee to
  75.        use any and all of our line of premium CD-ROM products.
  76.  
  77.        For example, a purchaser of both volumes 1 & 2 of the MS DOS CD-ROM
  78.        who runs a BBS system will only pay a an annual fee of $1 to run
  79.        both CD-ROMS on his system.  You need only pay once, but a seperate
  80.        license form must be completed and returned for each CD-ROM disc
  81.        you run on-line.

  83.        License fees are due and payable within 30 days of your purchase of
  84.        this CD-ROM disc.  All licenses are non-transferrable.
  85.  
  86.    10. Licensee agrees to notify New Frontiers CD-ROMS, if they have or
  87.        gain knowledge of individuals or organizations that are violating
  88.        the terms of this License Agreement or New Frontiers copyright(s)
  89.        and/or trademark(s).

  91.    11. Should legal action result between New Frontiers CD-ROMS and its
  92.        Licensee due to the violation of, or concerning, any of the
  93.        provisions of this Agreement, the Licensee shall be responsible for
  94.        all attorneys fees and related legal expenses, including, but not
  95.        limited to, loss of business and profit to New Frontiers CD-ROMS.
  96.        Should litigation be necessary, any action will be filed in the
  97.        County of Litchfield, State of Connecticut.
  98.  
  99.    12. The New Frontiers CD-ROMS Shareware CD-Rom is not licensed for use
  100.        on BBS systems operating outside the USA.  For other countries,
  101.        contact New Frontiers CD-ROMS for any special local license
  102.        requirements.  New Frontiers CD-ROMS reserves the right to limit
  103.        the number of licenses granted in selected geographic areas of the
  104.        world.  No BBS licenses will be issued in the state of Connecticut.
  105.  
  106.    13. This License shall be construed under the laws of the State of
  107.        Connecticut.  This Agreement sets forth the understanding between
  108.        New Frontiers CD-ROMS and the BBS Licensee; it may be changed or
  109.        modified only in writing and must be signed by the Licensee.
